These Terms of Service ("Terms") govern your use of the NexVPN application and services ("Service") operated by NexVPN ("we", "us", "our"). By downloading, installing, or using NexVPN, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Description of Service
NexVPN provides a Virtual Private Network (VPN) service for Android devices. The Service encrypts your internet traffic using WireGuard protocol and routes it through our server infrastructure to protect your privacy and security online.
3. User Responsibilities
When using NexVPN, you agree to:
- Use the Service only for lawful purposes
- Not attempt to breach, circumvent, or test the vulnerability of our systems
- Not interfere with or disrupt the Service or servers connected to the Service
- Not use the Service to transmit any malicious code, viruses, or harmful data
- Comply with all applicable local, national, and international laws and regulations
4. Prohibited Uses
The following activities are strictly prohibited while using NexVPN:
- Distribution of illegal content or materials
- Sending spam, phishing emails, or unsolicited communications
- Launching attacks against other computer systems or networks (DDoS, hacking, etc.)
- Copyright infringement or intellectual property theft
- Any activity that violates the laws of your jurisdiction
- Reselling or redistributing the Service without authorization
5. Service Availability
NexVPN is provided on an "as is" and "as available" basis. While we strive to maintain high uptime and reliability, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.
6. Beta Service
NexVPN is currently in open beta. During this period, the Service is provided free of charge. Features, server locations, and availability may change as we develop the product. We make no guarantees about the continuity of the free tier once the beta period ends.
7. Limitation of Liability
To the maximum extent permitted by applicable law, NexVPN and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.
In no event shall our total liability exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the liability.
8. Account Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason including, but not limited to, a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
9. Intellectual Property
The NexVPN application, including its design, code, branding, logos, and documentation, is the intellectual property of NexVPN. You may not copy, modify, distribute, sell, or lease any part of our Service or software without our explicit written permission.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with applicable international laws, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved through good-faith negotiation or, if necessary, binding arbitration.
